Default parking fines in car parks - 04-13-2008 , 12:02 PM






has anyone won against a council i paid for a ticket but it got stuck under
another ticket so the attendant gave me a ticket, is there any legal points
to throw at them.

I guess if you have the paid for ticket with the correct date and time
on it, showing that you had paid, when they issued you a ticket then
you can obviously appeal. Simply, send it back and say look I paid.
Don't bother to explain it fell on the floor, etc, say it was clearly
displayed in the windscreen then it will make thier traffic warden
look like an idiot who didn't check your ticket correctly, thus thier
fault.

You mean the traffic warden who would have taken a photo, as they're
obliged to do now, thus showing the appeallant to be an outright liar?

I stupidly put a valid sticker upside down on the dash. The warden was
writing the ticket out as I got back to the car. He told me he couldn't
cancel the ticket, but it would be waived if I appealed. I did so
successfully.

I don't think you or I had any legal rights to avoid the fine, but it has to
be worth writing surely?

I never did it, but a company I used to work for had an unofficial
policy that if 2 engineers had to park ing the same pay car park only
one would buy a ticket and if the other got a fine they would send
that ticket in and get the fine cancelled (yes I know, tight
whatevers). Things may have changed (photots or something) but it is
probably worth a try.

I've done it before, but I'm capable of writing a letter and ccing it to the
local MP and concillors. You're not capable of putting a sentence together.

Basically the council will have most things covered so to ensure that it's
not simple to get out of a parking ticket. You need a good reason why you
don't deserve a ticket. I would suspect that a well written letter, with a
photocopy of the valid ticket would be enough. Again, CC it to your
councillor and MP. And ensure you appeal before the ticket doubles up from
£30 to £60 - once the appeal is in, the doubling up process is halted.

I was watching a traffic warden out of my office window last week. He
spent ages taking loads of photographs, even several through the side
windows. Either he was bored or he was being _very_ careful to avoid
claims that the ticket had fallen down or whatever.

Everyone should appeal EVERY ticket they get, even if they were in the
wrong, as there is always a chance you'd get off, or at the very least
if everyone appealed it would clog up the system and teach the
councils they can't make money out of fleecing motorists, because
thats what 80% of all parking fines are. Don't belive the "oh its for
congestion or residents, etc" that might be true for some yellow
lines, but the majority are there for one thing, making money. The
same with speed cameras, agian, appeal, ask for photos, etc.

Mess them about (within the law) and cost them money, why make it easy
for them!

Alternatively, you could try parking legally...

clogged up. You fuckers are incapable of controlling yourselves as
recent events in towns with no traffic wardens have shown.

Problem is, in places like Central London, plenty of people (especially
delivery drivers) get loads of tickets for parking illegally, but in a place
that wasn't obstructive in any way (i.e. road plenty wide enough, etc etc).
I once got a ticket on High Holborn, on the one-way bit, just approaching
the Southampton Row/Kingsway traffic lights. Ordinarily this would sound
like an insane place to park, but (a) I was delivering to a building
virtually right on that junction (no excuse in itself, but....) (b) there
was a bit of dug-up road in the left lane, taking out the whole lane,
*immediately* in front of where I'd parked (and I mean stopped for a couple
of minutes to make a delivery), meaning I wasn't hindering the traffic flow
in any way, shape or form.

Compare that to the fuckwit who parked on Shaftesbury Avenue in the left
lane (just approaching Piccadilly Circus, where it branches off to the
left - Great Windmill Street), meaning as soon as the queue for the right
turn filter exceeded 3 cars, it jammed the whole of Shaftesbury Avenue up
and caused fucking gridlock for a good half a mile back. No ticket on that
van. Or someone parking in a similar place right near a crossroads in
Ealing (just past South Ealing station heading towards Brentford/A4/M4) - a
very well-used cut-through, and although not quite Piccadilly Circus, it
still caused relative chaos around there - 10-20 cars getting held up
waiting for a car to get a gap to turn right when they shouldn't have had
to. No ticket on that car either.
