LOL, no doubt. I never thought DW would be so greedy. The quote is not
even that good. It was kinda cute at first, but now it's just old and
tired. Trademarking such a word shows me DW is VERY full of himself.

Hey DW, your fans have been kind to you. Your whole "boogity" thing
has been stupid from the start.

I think the store merchant should use a spelling variation like
boogidy or boogety. DW would then try to trademark those words as
well.

Good point. If that's the way trademarking works, it doesn't seem
right, fair.

Could and would are two very different things.

Had you ever heard of this little shop in Canada before?
If DW hadn't made a stink about it, nobody else would have either.
Because you "can" do something, doesn't always mean you
"have" to....

There's quite a difference in using someones image or likeness
on t-shirts or diecasts, to what this guy was doing.

If the situation ever got so where this guy or any other person,
got into the wallet of Waltrip, then go for it by all means.

Exactly so. Waltrip doesn't own the word, it's been in wide (more
or less) usage in English for at least 50 years. All Waltrip can
claim is the right to use it as a race introduction, or in
association with his name or image (and, likewise, to constrain
anyone else from using it to suggest an association with Waltrip).

And merchandising. And it's only the full phrase "Boogity Boogity

The shop owner wouldn't have to put up much of a defense at all and the

I remember hearing about a case some years back where CBS filed a suit
against a guy in Texas who had an Oil Company named Ewing Oil. Found
out his name was Ewing and his company preceded the CBS Show Dallas .
Case dropped. I thought he should sue CBS for defamation of Character
Old JR wasn't exactly a role model for business
