LOL. I'll help you out, I dislike Waltrip more. Jay's an

I 'think' the editor nowdays is actually a guy who used run a website called
bgnracing.com, whom I haven't ever come across but is regularly derided as
an absolute prick by the old time users of that website. (and at least 2
Nationwide series team owners)

Actually, I beleive they're allowed to report a general status
"admitted to the hospital and listed in critical condition" or
whatever the hospital says.
Don't think so. We see news all the time, where "information on [his]
condition was not available." I'm not sure that confirmation that
someone is in a specific hospital is available....

And just as often the news reports "in critical condition". When
they say "not available" it simply means no-one answered when
they called (or, equally often, that they were in too much of a
hurry to get the article done to make the call).

if that breathalyser were given in ontario (where i live), he'd
have been cited for a DUI, they recently changed the legal limit
from .08 to .05
And he would have easily gotten off.

i dunno about that, we've had a few hockey players get DUIs around
here and not gotten off.

I don't any thing about the law up there, but .01 over here in the
states, with a good atty, you will not be charged with DUI.

It's automatic 6mths licence suspension and $1500 fine for a 1st offence at
.05-.08 here, and I've hardly ever heard of anyone being given an inch.

Go over .08 and the penalty doubles plus jail time is available.
It doesn't matter if it is .01 when you are involved in an accident

......unless apparently your name is Waltrip

Well, my respect for Jayski just went down several notchs. *"Waltrip
hits motorcycle, is OK". *How about a little concern for the guy
riding the motorcycle? *A drunk in an SUV runs into him and sends
him to the hospital, and we don't even get a hint of sympathy?

Not Jayski's fault. The article he quoted from didn't have any news on
the condition of the motorcyclist either.

The bit I quoted is almost certainly Jay's wording. *And the sense
of it is clearly "Waltrip's OK, that's all that matters".

John

that was the biggest problem i had with the article was that jayski
seemed to care more about the condition of mw than the motorcyclist,
he was certainly injured you cannot be hit by a car on a bike and be
okay (most of the time). I have never been breathalyzed so i don't
know how a .08 reading would be but certainly the judgment of a driver
is impaired with every drink. I believe .05 is a good limit to have,
it makes people think twice before hoping in their cars when leaving a
bar or party. In ontario it isn't a set limit at .05, but if you're
pulled over at .05 the cops give a judgement call as to whether or not
you are in the mind to drive. but if u hit .08 or higher then its a
dui. if you get a DUI at .05 or higher its a suspension of 3-30 days
the first time you're caught.
They can make it a .01 and would still let certain people get away
with it.

Mikey will probably get sued.

He should be in jail for a DUI as any one of us would be. When you
are involved in a collision and a cop suspects anything more than a
..00, regular people are screwed

Apparently Waltrip was. I'm told that in N Carolina they have
DWI (tested over .08) _and_ DUI (less than .08 but in the officer's
judgement affected by alcohol). I understand the citation
Waltrip was given included DUI.

I hope so. I am still puzzled why it wouldn't make the news though.
Almindinger's sure did. If you compare the two, Waltrip's was far
worse in that there were injuries and property damage {again}

That pretty much erases any doubts we might have had about Waltrip's
accident a couple of years ago...he couldn't walk home from this
one in his socks, and hide in the back of the house.

Given that Waltrip is a major star (unlike, say, Mayfield) I doubt
NASCAR will be in a big hurry to subject Waltrip to extra testing,
altho it would seem to be warranted.

John
Wonder what Best Western thinks about it. He had just done a promotion
at some families home, a very large Italian family, that won some
contest and gave money for book bags or something and was probably on
his way home from that. Nascar Now had him on last night live from the
home. Come to think of it he was acting kind of silly (even more than
usual). Probably a good thing there was a lot of food (obviously drinks
too) being fixed and served or he might not have passed.

Not in FL.
