A drunk in an SUV runs into him and sends him to the hospital, and we don't even get a hint of sympathy? I can't figure out which you dislike the most, Jayski or Mikey. |

Regardless of who reported what, and how, HIPAA rules forbid releasing information about the cyclist's condition unless he agrees to it. Actually, I beleive they're allowed to report a general status "admitted to the hospital and listed in critical condition" or whatever the hospital says. |

We see news all the time, where "information on [his] condition was not available." I'm not sure that confirmation that someone is in a specific hospital is available.... |

Not Jayski's fault. The article he quoted from didn't have any news on the condition of the motorcyclist either. The bit I quoted is almost certainly Jay's wording. *And the sense of it is clearly "Waltrip's OK, that's all that matters". John that was the biggest problem i had with the article was that jayski seemed to care more about the condition of mw than the motorcyclist, he was certainly injured you cannot be hit by a car on a bike and be okay (most of the time). I have never been breathalyzed so i don't know how a .08 reading would be but certainly the judgment of a driver is impaired with every drink. I believe .05 is a good limit to have, it makes people think twice before hoping in their cars when leaving a bar or party. In ontario it isn't a set limit at .05, but if you're pulled over at .05 the cops give a judgement call as to whether or not you are in the mind to drive. but if u hit .08 or higher then its a dui. if you get a DUI at .05 or higher its a suspension of 3-30 days the first time you're caught. |

You guys are missing the point totally. It doesn't freakin matter, you can be less than .08 while being involed in an accident and the cops will assign you a DUI (unless your name is Waltrip) |

I'm told that in N Carolina they have DWI (tested over .08) _and_ DUI (less than .08 but in the officer's judgement affected by alcohol). I understand the citation Waltrip was given included DUI. Given that Waltrip is a major star (unlike, say, Mayfield) I doubt NASCAR will be in a big hurry to subject Waltrip to extra testing, altho it would seem to be warranted. John Wonder what Best Western thinks about it. He had just done a promotion at some families home, a very large Italian family, that won some contest and gave money for book bags or something and was probably on his way home from that. Nascar Now had him on last night live from the home. Come to think of it he was acting kind of silly (even more than usual). Probably a good thing there was a lot of food (obviously drinks too) being fixed and served or he might not have passed. You guys are missing the point totally.
