if that breathalyser were given in ontario (where i live), he'd have
been cited for a DUI, they recently changed the legal limit from .08
to .05

I was around 20 when the limit changed from .08 to .05 in Australia and I
can honestly say in hindsight, at that age, I was toasted at anywhere near
the old .08 limit.

Personally I think even at .05 I would be driving knowing I'm too tipsy.
(I'm a pretty big 45yo bloke now too)

accident a couple of years ago...he couldn't walk home from this
one in his socks, and hide in the back of the house.

Given that Waltrip is a major star (unlike, say, Mayfield) I doubt
NASCAR will be in a big hurry to subject Waltrip to extra testing,
altho it would seem to be warranted.

Not Jayski's fault. The article he quoted from didn't have any news on the
condition of the motorcyclist either.

Wonder what Best Western thinks about it. He had just done a promotion
at some families home, a very large Italian family, that won some
contest and gave money for book bags or something and was probably on
his way home from that. Nascar Now had him on last night live from the
home. Come to think of it he was acting kind of silly (even more than
usual). Probably a good thing there was a lot of food (obviously drinks
too) being fixed and served or he might not have passed.

Yeah, I remember back when that happened, several in the NG defended the
stinkin' drunk.
All this does is just backs my initial contention that if it walks like a
duck & quacks like a duck, it's usually a duck - or a drunk in this case.
Because the police & prosecutors didn't do their job when they let him slide
on the first DUI, some innocent motorcyclist had to pay the price. I hope
that biker sues all of their asses.
I bet if they hauled him in & stuck a needle in his arm, he'd have made to
that .08 plateau...

Not Jayski's fault. The article he quoted from didn't have any news on
the condition of the motorcyclist either.
The bit I quoted is almost certainly Jay's wording. And the sense
of it is clearly "Waltrip's OK, that's all that matters".
