What if?

Since Stewart as much as admitted he purposely ran into Kenseth at 190
mph, causing a wreck I was wondering what if someone would have been
killed when Kenseth went spinning across the track. Honestly wouldn't
he have had to be charged with Manslaughter? Imagine tony in jail he
would make someone a good wife I am sure.
